Draft. These terms haven’t been reviewed yet and aren’t in effect. Items in square brackets are still to be decided.

Terms of Service

Effective [Effective date, set at launch]

These terms cover this website and the Lost at Faire service. By using either, you agree to them. We’ve tried to keep them plain.

Who we are

Lost at Faire is run by Thought Software (“we”, “us”). You can reach us at [contact email].

Who these terms are for

  • Patrons: anyone who reports a lost item, or uses a status link to check on a report.
  • Faire staff and volunteers: anyone with a staff account at a faire that uses Lost at Faire.
  • Visitors to this website, including anyone who requests a demo.

A faire that uses Lost at Faire also signs an agreement with us. That agreement covers the faire’s use of the service, and where it differs from these terms, it’s the one that applies to the faire.

What Lost at Faire does, and doesn’t do

Lost at Faire is software that helps a faire run its lost and found. Staff use it to log found items, take reports of lost ones, and see possible matches.

The faire runs its lost and found, not us. We never hold, handle, or ship anyone’s belongings. The faire decides:

  • whether an item that’s been found is yours, and what proof it asks for before handing it over;
  • how long it keeps unclaimed items, and what happens to them afterwards;
  • how and when its staff contact you.

Possible matches come from simple rules, and a person on the faire’s staff always makes the final call. We can’t promise that a lost item will be found or returned.

If you report a lost item

  • Please give accurate details. The more precise your description, the better staff can match it.
  • Only report items that are yours, or that you’re reporting for someone who asked you to, such as your child.
  • If you get a status link or QR code, keep it private. Anyone who has it can see and update your report while it works (30 days).
  • Your details are handled as our Privacy Policy describes. Personal details are removed 180 days after the faire ends, or sooner if you ask.

If you have a staff account

  • Your account is for your own use. Don’t share your password or let anyone else sign in as you.
  • Use the service, and the information in it, only for the faire’s lost and found. Patrons’ names and contact details are there so staff can return belongings, and for nothing else.
  • You’ll only see the faires you’re assigned to. Don’t try to reach information you haven’t been given access to.
  • The faire can change or remove your access at any time, for example when you stop volunteering.
  • If you think someone else has used your account, tell the faire or us straight away.

Things nobody may do

  • claim an item that isn’t yours, or give false details to get one;
  • try to get into accounts, faires, or information you haven’t been given access to;
  • test, probe, or attack the service’s security without our written permission;
  • overload the service, or use automated tools to send requests or fill in forms;
  • use the service to break the law or to harass anyone.

We may suspend access, or refuse a request, where someone does any of these.

Availability

The service is built to work over a poor connection, such as a phone signal on a faire field, but it has no offline mode: saving an item or report needs a connection. We work to keep it running, especially on faire weekends, but it may sometimes be unavailable, for example during maintenance or an outage. [Decide whether faires get a service commitment, and put it in the faire agreement rather than here.]

Our name and content

The Lost at Faire name, logo, and this website belong to Thought Software. Faire names and logos belong to their owners. Information you or a faire’s staff put into the service stays yours or the faire’s; we use it only to run the service, as the Privacy Policy describes.

Disclaimers and liability

[To be written with legal review. It should cover at least:

  • that the service is provided as is, without guarantees beyond those the law requires;
  • that we aren’t responsible for the belongings themselves, or for a faire’s decisions about them;
  • any limit on our liability, and the rights under local law that no limit can take away.]

Changes

If we change these terms, we’ll post the new version here with a new effective date. If a change is significant, we’ll also let the faires using the service know.

Governing law

[The state or country whose law applies, and where disputes are resolved.]
